Commercial

  • The firm obtained a $7.5 million judgment on behalf of a bio-pharmaceutical company through a "AAA" arbitration proceeding wherein the terms and conditions of a license and development agreement and a manufacture and supply agreement regarding a new pharmaceutical drug product were successfully enforced.

  • The firm obtained a judgment in excess of $100,000,000 for a municipality that was the victim of an elaborate fraud involving the management of its self-insurance program.

  • The firm represented a company engaged in the business of designing and manufacturing pre-lit artificial Christmas trees, pre-lit artificial wreaths, indoor and outdoor holiday lights and other related products. Our client terminated the distributorship agreement it had with a nation-wide distributor of these products, and the distributor sued for breach of the distributorship agreement, breach of fiduciary duty, tortious interference with business expectancies and other related claims. The firm successfully represented the client in the litigation, obtaining dismissal of many of the primary causes of action and then negotiated a settlement whereby our client paid less than ten percent (10%) of the damages claimed by the distributor.

  • The firm represented a financial institution in an investigation of the conduct of a board member and developed a plan for the institution which would both resolve the problem with the existing board member and prevent the conduct from occurring in the future with other board members. As a result of the firm's work, an agreement was reached between the board member and the institution and further liability to the institution was avoided.

  • The firm represented a California corporation in a trademark dispute over the use of a certain painting which was silkscreened and sold in large numbers by a national discount chain. The firm was able to obtain injunctive relief and eventually reach a settlement which provided for a disgorgement of the profits wrongfully made by the defendant's misuse of our client's product.

  • The firm represented a large real estate developer who entered into a store lease with one of the largest clothing designers in the world for that designer to develop a Chicago flagship store. After incurring substantial construction and other expenses to ready the premises, our client was notified by the designer that it would no longer rent the space. A declaratory action was initiated in federal court and a substantial verdict was rendered in favor of our client. The firm was able to preserve that verdict on appeal and settle the matter for a multi-million dollar amount.

  • The firm structured a settlement agreement to resolve litigation between a franchisee, our client, and a franchisor in a dispute over territory under which the franchisee was able to sell his business to the franchisor at the largest price ever paid for a franchise by the franchisor.

  • The firm represented one brother in a family dispute over the control and operation of a retail food business. The business involves several retail locations as well as separately owned real estate which operated as parking facilities for the business. Under the resolution, our client sold his interest in the retail operation, secured long term leases to provide income from the parking facilities and retained his ownership in the real estate limited liability company.
