His practice includes a concentration in representing clients engaged in federal and state court litigation and arbitration proceedings concerning securities, construction and business disputes, violations of restrictive covenants and breach of fiduciary duties. He represents corporations, partnerships, directors, officers and management personnel. Mr. Rotunno also represents clients involved in a variety of other commercial matters, including fraud, corporate and contract litigation in jury, non-jury and appellate proceedings. He has also represented clients charged with legal and accounting malpractice. Mr. Rotunno has been recognized by his peers as an Illinois "Leading Lawyer," among the upper five percent of all Illinois lawyers who practice in the following categories: Commercial Litigation; Construction Law; and Insurance, Insurance Coverage & Reinsurance Law. Professional Associations & Affiliations A member of the Trial Bar of the United States District Court for the Northern District of Illinois, Mr. Rotunno also serves as an arbitrator for the National Association of Securities Dealers. He has represented clients in proceedings before the New York Stock Exchange, the NASD, the American Arbitration Association and the Securities and Exchange Commission. Mr. Rotunno is a member of the American Bar Association and the Chicago Bar Association. He is also actively involved in the Chicago Bar Association, where he served as a member of its Board of Managers and chaired the Young Lawyers Section, a group of 11,000 attorneys. He was a member of the Board of Directors of the Chicago Bar Foundation, and he is a member of the American Subcontractors Association (Chicago) and the Professional Liability Underwriting Society. Education/Work History J.D., Loyola University of Chicago, 1978 B.S., Finance, University of Illinois at Champaign, 1975 (Graduated Phi Beta Kappa) Mr. Rotunno began his legal career with Joyce & Kubasiak, P.C. in 1978, where he became a partner in 1986. In 1991, he joined Sedgwick, Detert, Moran & Arnold, a San Francisco-based international law firm, where he co-directed the litigation department of the Chicago office. He joined Kubasiak, Fylstra, Thorpe & Rotunno, P.C. in 1995. Publications Mr. Rotunno is a co-author of the "Commercial Liability Issues" chapter of the Healthcare Liability Desk Book. He has also authored the article "Making Healthcare Business Decisions Without Being Sued" published and presented at the seminar: Healthcare Liability Issues in the 90's (January 1995). Mr. Rotunno authored the article "Standard of Liability for Directors and Officers of Federally Insured Depository Institutions in Civil Suits Brought by the FDIC" published in the Illinois Bankers Association's IBA LAWwatch (Summer 1992) and the article "Beware of the Written Change Order Requirement Provision in Construction Contracts" published in the periodical Construct! by the ABA Committee on Construction Litigation (Spring 1994). Mr. Rotunno also prepared a paper entitled "Fidelity Bonds-Discovery of a Loss and Notice to the Insurer" which was presented to the Chicago Surety Claims Association in April 1993. He has written for the American Subcontractors Association, including articles entitled: "Specifications and Drawings - Which Take Precedence if There is a Conflict," "Claims Against Owners for Failing to Provide Superior Knowledge of a Site Condition," and "Bad Weather - Is It an Excusable Delay."
