Mr. Kimmeth concentrates on resolving complex business disputes through strategy designed to minimize litigation and utilize alternative dispute resolution, including mediation and/or arbitration whenever feasible.

Mr. Kimmeth has achieved successful results for clients, ranging from large public and privately held corporations to individual entrepreneurs, in matters involving contract disputes, allegations of construction and engineering/design defects, disputes involving securities and regarding negligence in the provision of financial services, denial of insurance coverage, and disputes over trust/estate asset distribution.

Representations include:

  • A national general contractor in several multi-million dollar matters involving multiple parties and construction and engineering defect, delay, subcontractor lien, and/or insurance coverage claims;
  • A bankruptcy trustee for a national trucking company in a multi-million dollar arbitration proceeding against a Big Four accounting firm involving audit negligence and complex causation, business valuation, and economic loss issues;
  • A private import/export and distribution company and its sales representatives in a multi-million dollar action alleging breach of joint venture, distributorship, franchise, and sales representative agreements;
  • A high net worth individual in an action against multiple financial services professionals whose advice caused the client to purchase a $500,000 fraudulent charitable gift annuity;
  • A major steel company in a multi-million dollar breach of contract/insurance coverage action involving a major mill explosion and fire and complex technical and damages issues;
  • A Lake Shore Drive high rise co-op board in an action against multiple professional defendants involving faulty construction and repair;
  • An investment banking firm and its officers in multiple actions in multiple jurisdictions involving allegations of securities fraud and professional negligence;
  • Top-tier brokerage firms in NASD and NYSE securities arbitrations involving investment losses restrictive covenants, and/or broker terminations; and
  • A bank trustee/executor in litigation over the valuation and distribution of plaintiff’s share of a multi-million dollar estate.


Professional Associations & Affiliations
Mr. Kimmeth was admitted to the Illinois bar in 1996 and has appeared before United States District Courts in the Northern District of Illinois and in the Southern District of New York, and before the Illinois Appellate Court. He also has practiced in circuit courts in Northern and Central Illinois, Indiana, New York, Florida, and Massachusetts and in various alternative dispute resolution forums. Mr. Kimmeth has achieved successful results in providing pro bono legal services for the Leadership Council for Metropolitan Open Communities and for the Center for Disability and Elder Law, and currently represents and is a Board Member of the Bohemian Theatre Ensemble, a Joseph Jefferson Award-winning theatre company in Chicago. Mr. Kimmeth is the President of the Rockledge Foundation, a charitable organization that provides scholarships and grants for education-related purposes, and is a Board Member of the Institute for Clinical Social Work, an organization dedicated to fostering high quality social work through providing academic programs for scholars and clinical practitioners and community program support. Mr. Kimmeth is also a member of the Chicago and American Bar Associations.

Before attending law school, Mr. Kimmeth worked as a Senior Management/Financial Consultant with Price Waterhouse in Washington D.C., where he analyzed economic feasibility and organizational performance. Projects included: constructing a financial/cost-allocation model to assess the viability of a proposed $2 billion Illinois airport; developing a methodology to evaluate the performance of NASA research and development Centers for the Commercial Development of Space; conducting economic and market analyses to position potential entry into the mobile satellite services market; and providing policy/cost evaluation to convert food assistance programs to Electronic Benefit Transfer systems.

Prior to joining Kubasiak, Fylstra, Thorpe & Rotunno, P.C., Mr. Kimmeth practiced law for 6 years with Katten Muchin Zavis Rosenman in Chicago.

Mr. Kimmeth is also vocalist for the Barristers Big Band and performs in the Chicago Bar Association's annual Christmas Spirits show.
